General rental conditions

1  Reservation
You can reserve by phone or through internet (online).
Reservations are binding for both you and spainholidays4u.
The rent period has to be at least one week.
Each reservation order will be confirmed by spainholidays4u by means of a reservation attachment.  After having received the confirmation, you’re obliged (compelled) to pay 30% of the rent amount within 7 days. Only after we have received your down payment in accordance with the agreement, your reservation will be final. The remnant of the rent amount has to be deposited on our banking account not later than 8 weeks before the beginning of the rental period.  In case of a short-term reservation you’ll have to pay the entire rent amount at once. We are entitled to cancel the reservation if the payment hasn’t been settled on time. For verification at your arrival you’ll have to show the reservation form and a valid proof of identity to our staff members on the spot.

2. Change of general conditions
Spainholidays4u reserves the right to change these general conditions at all times without having notified you beforehand and you agree that your use of this site is subjected to the general conditions which apply to that very moment.

3. Cancellation
Cancellation is possible within 8 days from the reservation date.
In case of cancellation after 8 days and until 8 weeks before the start of the rental period, 30% of the rent amount will be charged.   In case of cancellation during 8 until 4 weeks before the start of the rental period, 60% of the rent amount will be charged. Cancellation can be announced by means of an e-mail or a letter. The administration costs, which will be charged in all cases of cancellation, amount to Euro 25,00.

3.1 Cancellation by Spainholidays4u
If, in any situation Spainholidays4u, pushes for cancellation of a booking for a rented holiday home notification will be directly made and where possible an alternative offered. By non-acceptance of the alternative, Spainholidays4u will reimburse the renter immediately with payments already made. The renter then gives up any rights other than the reimbursement of paid costs.

4. Liability
Spainholidays4u only mediates between owner and tenant and consequently cannot be held responsible by the tenant in case of accident/injury/damage, which occurs during the rental period. Spainholidays4u reserves the right to refuse guests or to cancel reservations. if there is a valid reason for this. In any case the responsibility of spainholidays4u cannot exceed the amount of the rent which has been paid by the tenant.  Spainholidays4u can never be held responsible for damage and/or costs, which have been suffered by the tenant. Spainholidays4u isn’t responsible for not culpable errors in the description on the  spainholidays4u site  or on the advertisement portals which are published on the internet.

5. Damage
During your stay in the holiday home you and/or your travel companions as tenants are fully responsible for the rented holiday home. Caused damage has to be paid to the landlord on the spot. Spainholidays4u  cannot accept responsibility for loss, theft, damage or injury, which is directly or indirectly caused by yourself. Spainholidays4u.com can also not be held responsible for damage which is caused by natural disasters, assaults, strikes and the like.

6.1 Deposit
Beforehand you’re obliged to pay a deposit, which will be paid back on your bank/giro account within 10 working days after your departure (your last rental day). If after your stay any damage or breakage might be detected, the costs of repairing  this will be balanced with your deposit. The amount of the deposit is mentioned in your reservation confirmation. Besides you’ll have to identify yourself at your arrival by means of a passport or identity card.

6.2 Youngsters
In case of youngster groups the usual deposit amount will be raised with Euro 100,- per person. Apart from  this the costs of an obliged and to be paid for final house cleaning is applicable. The deposit will be paid back on their bank or giro accounts within 10 working days after departure and after a check on the state of the used accommodation.

6.3 Age restriction
Various accommodations are not available for youngsters or for youngster groups.  If at the arrival it appears, that nevertheless a group of persons with an average age of less than 25 years has made a reservation, their entrance will be refused and paying them any restitution whatsoever is absolutely out of the question.

7. Insurance  
We advise you to take out a solid travel insurance and/or a cancellation insurance.

8.1 Tenant
Between 22.00 o’clock and 7.00 o’clock we request you not to make noise/music which prevents the local residents from having a good night’s rest. In case of ascertained nuisance caused by the tenant, Spainholidays4u has the right and authority to cancel the rental agreement immediately without any restitution at all of the paid rental amount or deposit.

When leaving (checking out of) the accommodation, the tenant has to see to it that:
Garbage has to be placed in the central garbage containers.
Crockery, cutlery and kitchen utensils have to be left in a clean state in the for that purpose meant place.
The dishwasher has to be emptied and left behind in a clean state.
The bedding has to removed.
The barbecue/hearth has to be left clean and empty.
The garden and the terrace have to be free of garbage (like cigarette filters).
The garden furniture has to be put back in the places where it had been put into service on the first rental day.
Extra cleaning costs can be charged when the house is not being found clean by the owner (landlord) and/or by the controller of spainholiday4u.

8.2. Responsibilities of the tenant
The tenant is responsible for a good treatment of the rented property and is consequently liable for possible damages caused by the tenant or fellow travellers during his/her/their stay.

9. Pets
Pets are not allowed everywhere. You can recover information about this this in the description of the holiday house.

10. Bedding
Bedding can be rented if it isn’t offered with the holiday home.  Please let us know if you prefer this service when you make your reservation. You’ll have to bring along towels, tea towels etc. yourself, unless mentioned otherwise. It’s not allowed to sleep in the beds without using bedding.

11.1 Opening hours
Outside the high season it could be possible (it could occur) that on certain days or hours the on our site mentioned facilities like for example: swimming pools, restaurants or shops, will be (temporarily) closed. Spainholidays4u cannot be held responsible for the fact that, regardless of the reason, during your holiday certain facilities were not  accessible.

11.2 Arrival and departure
You can dispose of your holiday villa / flat on the first rental day between 16.00 o‘clock until 20.00 o ‘clock.  The costs of an arrival, which takes place after 20.00 o’clock (after having been announced), amount to Euro 50,-. The holiday villa / flat has to be left on the day of departure before 10.00 o’clock in the morning.
In case of departure after 10.00 o’clock, additional costs have to be charged!

12. Number of persons
The number of persons which has been put down in writing in the description of the holiday home,  is the maximum allowed number. Occupation with more than the number of persons, which is indicated during the reservation, isn’t allowed. Placing a tent, a caravan or a camper is not allowed too. In case of exceeding these rules,  the  rental agreement is considered to be legally annulled and the entrance to the holiday home will be refused without the client being able to lay any claim on a restitution of the paid rent.

13. Inconvenience
It’s possible that during your stay in front of your holiday home or in the near vicinity road works are being executed. We understand that this can cause a nasty situation for you. Spainholidays4u cannot be held liable for this kind of inconvenience, because we have no influence whatsoever on this.  It’s also possible that during your stay the water- or power supply will be temporarily disturbed. Spainholidays4u.com cannot be held responsible for this either.

14. Complaints
If you might have a complaint at your arrival or during your stay, please turn to our staff members to give them the opportunity to solve your complaint. The tenant should report a complaint which arises at his/her arrival in the holiday home or during his/her stay not later than within 24 hours to our staff members.  Spainholidays4u will do its utmost to solve the complaint immediately on the spot.  You ought to give spainholidays4u at all times the opportunity to realize a suitable solution of the complaint. Early departure or independently moving into another accommodation, will release Spainholidays4u from any obligation to provide compensation. Spainholidays4u cannot be held responsible for loss or damage, which are caused by actions, negligence’s or omission by our contract partners.

15. Tourist tax
As from November the first 2012 Catalonia, as the first and only federal state/region in Spain, is going to introduce a tourist tax. Spainholidays4u also lets holiday homes in this region. With regard to these holiday homes you’ll have to keep in mind that at your arrival at our office our staff member are going to ask you to pay this tourist tax. These taxes concern both foreign tourists and Spaniards who are going on holiday in Catalonia.

Below a survey of the tax prices
Flats and holiday homes cost Euro 0,90 per night/person.
Prices are always per person per night for persons with the age of 16 years and older.   At the most 7 nights are being settled, so never more. The tourist tax has to be paid at our office on the spot.

16. General rental conditions
When you finish your reservation, you herewith automatically accept  that you have read and understood the general conditions and that you agree  with the contents of these conditions.
